There are a number of requirements for obtaining a marriage / civil partner visa namely:
- You and your spouse are legally married to each other or you have registered your civil partnership
- Your spouse / civil partner is present and settled in the UK or is travelling with you and settled in the UK
- You both intend to live together permanently
- You and your spouse / civil partner have met
- You have sufficient income or funds to support yourselves and any dependents without any help from public funds
- You have suitable accommodation
- Both you and your spouse are ages over 21
Note Spouses / civil partners seeking to come to the UK on the basis of marriage must apply for entry clearance before entering the UK and in certain circumstances there is an age requirement of 21 years.
Applicants already in the UK who wish to marry and thereafter switch into a spouse / civil partner visa must first apply for a Certificate of Approval and have at least six months remaining on their current visa.
Children of the marriage who are under 18 years old are allowed entry to the UK as dependants, and can make their application at the same time as the main applicant.
If a person has more than one husband or wife, only one of them will be allowed to join them in the UK as their husband or wife under the UK marriage visa.
